Subway shop lawsuit over wrongly accused worker dismissed

SALT LAKE CITY (AP) — A judge has dismissed a defamation lawsuit filed by owners of a Utah Subway shop where a worker was wrongly accused of drugging a police officer’s drink.

Court records show U.S. District Judge Dee Benson dismissed the case Thursday, ruling that Layton police did not make any comments indicating the Subway shop was negligent or could have prevented the incident.

The Subway shop’s owners said they suffered $300,000 in losses after a police spokesman gave interviews in front of the Layton store and claimed early tests showed THC and methamphetamine in the officer’s lemonade.

The owners say police waited two months to publicly refute the allegations despite evidence showing the officer had no drugs in his system.

The Layton City Attorney’s Office and lawyer Robert Sykes, who represents the Subway shop owners, did not return messages seeking comment Friday.
